Lindsay Lohan 'will NOT accept plea deal that involves jail time' in necklace theft case

Lindsay Lohan will turn down a plea deal in her necklace theft case if it involves jail time, it has been claimed.

The troubled star's lawyer Shawn Holley is currently negotiating a deal that will almost certainly involve a spell in prison.

At the last hearing the Judge Keith Schwartz told her she would face jail if she pleaded guilty or no contest to the felony.


But the 24-year-old actress has until March 10 to decide whether to except the charge or take it to trial.

According to celebrity website TMZ, Lohan wants to go to a jury trial because she believes surveillance tapes will clear her name.

Sources have told TMZ.com that the tape shows Lohan talking to the owner of the Kamofie & Company jewellery store in Venice Beach, Los Angeles, on January 22 for several minutes before walking out wearing the necklace.

According to the source, on the day in question, Lohan was seen in the video trying on the necklace, looking in the mirror, and appearing to ask both her friend and the store owner for their opinions.

TMZ says Lohan took off her own necklace to try on the shop's item, and continued to wear it for the next 45 minutes while trying on a variety of rings.

It is then claimed that Lohan put her own necklace back on before leaving the store, although her own necklace did not obstruct the view of the store's necklace, before talking to the owner and then leaving.


Meanwhile Lohan has other worries on her mind.

Following her father Michael's announcement that he was to take part in Celebrity Rehab, she made her displeasure clear.

'I am sorry that my father has continually chosen to speak publicly about our relationship, my mother, my siblings and my professional team,' Lohan told RadarOnline in a statement.

'I am working through my recovery day-by-day and find his public media bouts unnecessary and damaging.'
